YOGA, FITNESS & ACTIVITY LIABILITY WAIVER AND RELEASE AGREEMENT

Please read carefully. This is a legally binding document.

1. Acknowledgment of Risk

I understand that participation in yoga, mobility training, strength training, personal training sessions, workshops, open gym use, camps (including children’s art and yoga camps), special events, and any other activities conducted by All Y’all (collectively, the “Activities”) involves inherent risks.

These risks may include, but are not limited to:

• Muscle strains, sprains, tears, and soreness
  
  

• Ligament and joint injuries
  
  

• Falls or loss of balance
  
  

• Slips or trips on floors, mats, or equipment
  
  

• Equipment malfunction or misuse
  
  

• Aggravation of pre-existing conditions
  
  

• Dizziness, fainting, dehydration
  
  

• Cardiovascular events
  
  

• Emotional distress
  
  

• Serious injury, permanent disability, or death
  
  

I acknowledge that yoga and fitness activities are physically demanding and may involve close physical contact, hands-on adjustments, use of props, weights, resistance bands, blocks, straps, and other equipment.

I understand that injuries may occur even when reasonable care is taken.

2. Voluntary Participation

I voluntarily choose to participate in the Activities. I affirm that:

• I am physically able to participate.
  
  

• I have consulted a physician or chosen not to do so.
  
  

• I assume full responsibility for my participation.
  
  

• I will inform instructors of any injuries, medical conditions, pregnancy, limitations, or discomfort.
  
  

• I will stop immediately if I experience pain, dizziness, or distress.
  
  

If I am registering a minor child, I certify that I am the legal parent or guardian and give permission for the minor to participate.

3. Assumption of Risk

I knowingly and voluntarily assume all risks, both known and unknown, foreseeable and unforeseeable, associated with participation in the Activities.

This includes risks arising from:

• My own actions or inactions
  
  

• The actions or inactions of instructors, staff, contractors, volunteers, or other participants
  
  

• The condition of the premises at 4505 Magazine Street
  
  

• Equipment use or misuse
  
  

• Negligence of All Y’all
  
  

I understand that this is a broad assumption of risk intended to release liability to the fullest extent permitted by Louisiana law.

4. Release and Waiver of Liability

In consideration for being permitted to participate, I hereby release, waive, discharge, and hold harmless:

• All Y’all
  
  

• The property owner and landlord
  
  

• Employees, instructors, contractors, volunteers
  
  

• Guest instructors
  
  

• Event hosts
  
  

• Space renters
  
  

• Successors and assigns
  
  

from any and all claims, demands, damages, causes of action, losses, or liability of any kind arising out of or related to participation in the Activities, including those caused by negligence.

This waiver includes, without limitation:

• Personal injury
  
  

• Property damage
  
  

• Economic loss
  
  

• Wrongful death claims
  
  

I understand that I am giving up substantial legal rights by signing this agreement.

5. Indemnification

I agree to indemnify and defend All Y’all against any claims, lawsuits, damages, or legal fees resulting from:

• My participation
  
  

• My minor child’s participation
  
  

• My conduct while on the premises
  
  

• Damage to property caused by me
  
  

6. Medical Treatment Authorization

In the event of injury or medical emergency, I authorize All Y’all staff to seek medical care on my behalf if I am unable to do so.

I understand that:

• I am responsible for all medical costs incurred.
  
  

• All Y’all assumes no responsibility for medical expenses.
  
  

7. Communicable Illness Acknowledgment

I acknowledge that participation in group fitness and yoga activities may expose me to communicable illnesses.

I voluntarily assume the risk of exposure and release All Y’all from liability related to illness contraction to the fullest extent permitted by law.

8. Photography & Media Release

I grant permission for All Y’all to use photographs or video taken during Activities for marketing, social media, website, and promotional materials without compensation.

If I do not consent, I will notify staff in writing before participation.

9. Personal Property

I understand that All Y’all is not responsible for lost, stolen, or damaged personal property.

10. Space Rental & Third-Party Events

If I participate in an event hosted by a third party renting the space:

• I understand that the host is independently responsible for their programming.
  
  

• I still release All Y’all and property owners from liability for injuries occurring on the premises.
  
  

11. Severability

If any portion of this agreement is deemed unenforceable, the remaining provisions shall remain in full force and effect.

12. Binding Agreement

This agreement:

• Applies to all current and future participation.
  
  

• Is binding upon me, my heirs, executors, administrators, and assigns.
  
  

• Shall be governed by the laws of the State of Louisiana.
  

13. Acknowledgment of Understanding

I certify that:

• I have read this agreement in full.
  
  

• I understand its contents.
  
  

• I understand that I am waiving important legal rights.
  
  

I sign it voluntarily and without coercion.
